2009 SETTLEMENTS AND VERDICTS
In July, Merryl F. Weiner of our firm Case along with outside trial counsel obtained a jury verdict in the amount of $48,000,000.00. The case was tried in Supreme Court, Westchester County and involved allegations that the doctors and hospital failed to timely diagnose a spinal tumor leaving the young mother of two confined to a wheelchair.

In October, Merryl F. Weiner and Kevin J. Quaranta settled a wrongful death case in Bronx Supreme which alleged that the doctors in the Medical Group failed to follow up on the pathology reports following performing several colonoscopies. The settlement of $900,000.00 represented the damages for the death of a 71 year old Bronx man, who died from metastatic cancer.
2008 SETTLEMENTS AND VERDICTS
In 2008, our malpractice cases led the way for those we represent against medical providers culpable of injuring or causing the death of innocent patients. In July, Merryl F. Weiner of our firm settled a Bronx County medical malpractice case for 1.2 million dollars for the failure of a physician to diagnose a woman’s fatal cancer. Similarly, our office obtained a six figure award for a 65 year old woman who was disfigured by the plastic surgery of a physician. Finally, in August 2008 a jury awarded a Bronx woman $160,000 against the City of New York and Transit Authority when only $3,000 had been offered prior to trial. That verdict was taken by our Senior Partner and Trial Attorney, Kevin J. Quaranta.
Other cases involving our firm included several six figure awards for falls to clients in each of Bronx, New York and Westchester Counties. Kevin Quaranta also took a substantial verdict for our client in a Rockland County jury trial. The premier lawyer reference manual in the United States, Martindale-Hubbell Lawyer Directory, continues to hold our firm amongst the most highly rated in our geographic and professional area (including medical and general negligence). And in 2008 our firm has also begun representing nursing home victims for injuries and negligent care, particularly to those elderly patients neglected by nursing homes in violation of the New York State Public Health Law.

OTHER SETTLEMENTS AND VERDICTS
$450,000 Bronx County Settlement
For the wrongful death of a 44-year-old, unmarried Hispanic male who did not support anyone. The settlement represented the decedent's pain and suffering for some ten days after the emergency room physicians and clinic doctors failed to recognize the onset of an aortic (heart) rupture.
$350,000 New York County Settlement
For medically negligent cataract surgery upon a 62-year-old, unemployed Hispanic woman, leaving her blind in one eye after puncturing the membrane encasing the eye.
$150,000 verdict in Bronx County
For damages sustained by an unemployed woman who underwent gynecological surgery, resulting in perforation of her uterus and abdominal burns.
Westchester County Awards
$225,000
On behalf of a retired New York City police officer whose hip replacement was not properly aligned during surgery, causing recurrent dislocations, which necessitated further surgery some ten days postoperatively.
$200,000
On behalf of a store owner when a 79-year-old woman tripped and fell in a store due to the unevenly-constructed entranceway. As a result of the fall, she lost her left eye.
$237,000
On behalf of a middle-aged Hispanic woman who tripped and fell on a defective staircase. This led to a fractured shoulder necessitating surgery.
Cosmetic Surgery Settlement
Merryl Weiner, Esq. and Walter Begos, Esq., were lead counsel in a case involving cosmetic surgery, which was pending in Kings County, New York. The matter settled before trial for $300,000
Pedestrian Knock Down
Kevin J. Quaranta, Esq., tried a case in front of Bronx Supreme Court Justice Paul Victor. The case involved a Bronx college student who was a pedestiran knocked down by a car. The matter settled for $275,000.
Hospital Negligence
Kevin J. Quaranta, Esq., and Walter Begos, Esq., settled a case during jury selection which involved the negligence of a hospital located in Westchester County. The matter settled for $205,000.
Medical Malpractice/Wrongful Death
Merryl Weiner, Esq., and Kevin J. Quaranta, Esq., settled a medical malpractice/wrongful death case before trial which involved the failure to diagnose colorectal cancer. The total settlement for the family of the deceased was $600,000.
Hospital Negligence Case settles for $200,000
Walter A. Begos, Esq., and Kevin J. Quaranta, Esq., teamed up to settle a hospital negligence case for over $200,000. Under confidential terms, we note that our client, Rita A. was struck by a hospital gurney and suffered loss of wages and arthroscopic surgery. This compromised, reached during jury selection, was even more noteworthy as our case was venued in Westchester County.
Cruz v Manor & NYC Transit - $650,000 verdict
Quaranta & Associates' lawyers represented dozens of clients receiving substantial settlements or verdicts in personal injury claims. This included many six-figure results in medical malpractice, automobile, premises liability, and employment discrimination cases. We also took great pride in Kevin J. Quaranta's Bronx jury verdict for $650,000 in Cruz v Manor & NYC Transit.
Medical Malpractice Settlement - $600,000
Our medical malpractice area continues to grow under the supervision of Senior Associate Merryl Weiner, Esq., and Walter Begos, Esq., who recently finalized a $500,00 settlement for the family of a client whose doctor did not properly diagnose her terminal cancer. A co-defendant's $100,000 contribution later brought the total settlement to $600,000.

Our client was awarded $300,000 by a Westchester County jury as reported in a recent edition of the New York Verdict Reporter.
Jameson v Daughter of Jacob Nursing Home
Attorney Kevin J. Quaranta, as trial counselor for Cormeta Jameson against Daughter of Jacob Nursing Home of the Bronx, completed the case of this elderly lady who fell from a chair at that nursing home where she was an outpatient. Ms. Jameson alleged back injuries as a result of the negligence of the home on the theory that the home had not secured chairs in which Ms. Jameson was sitting. The case was settled prior to trial for close to $100,000.
